Polish-Czech working group of administrative judges

On 9-11 May 2018, in Hradec Králové, the seventh meeting of the Polish-Czech working group of judges of administrative courts took place. In this cyclical exchange of judges' experience of both jurisdictions, participated twelve judges from the Czech Republic, including the President of the Supreme Administrative Court of the Czech Republic, judge Josef Baxa, Vice-President of the Court, judge Michal Mazanec and Judge of the General Court of European Union Jan Passer, as well as 23 representatives of Polish administrative courts headed by the Vice-President of the Supreme Administrative Court of Poland (SAC), Director of the Judicial Decisions Bureau, judge Maria Wiśniewska and Vice-President of the SAC, President of the Commercial Chamber, judge Janusz Drachal.

The central point of the meeting was debate during the plenary session, within a number important for administrative courts issues were discussed. Czech participants presented last changes to the procedural rules regarding public administration in the Czech Republic as well as issues related to the functioning of the judiciary. In this context the reference to the relationship between the Supreme Administrative Court and the Constitutional Court of the Czech Republic and to the efforts to establish the Supreme Judicial Council of the Czech Republic, as well as to the Irish question in the Celmer case was made. As a ​​specific issues, Czech speakers presented regulations and case law concerning personal data protection, protection of classified information, as well as higher education. Polish speakers presented legislative changes in the Polish judicial system, as well as current changes of the administrative and administrative court proceedings. Also the specific issues, like the abuse of tax law and the tax system tightening in Poland and in the European Union were discussed.

Participants were also given a publication being the outcome of the previous meeting of the group, entitled "Administrative courts in Poland and in Czech Republic. Selected issues discussed within the framework of Polish-Czech cooperation of administrative courts judges. Wroclaw, October 17-18, 2016."
